First DUI Offense

  • Fines:  $250-$1,000
  • Probation:  up to one year
  • Jail Time:  up to six months (sometimes up to nine months)
  • License Suspension/Revocation:  180 days to one year
  • 50 hours community service
  • DUI school
  • Auto Impound:  one car for 10 days
  • Ignition Interlock Device:  not required (unless BAC is .02 or higher)

Second DUI Offense

  • Fines:  $500-$2,000
  • Probation:  up to one year
  • Jail Time:  ten days to twelve months (if within five years of a previous DUI conviction)
  • License Suspension/Revocation:  180 days to five years
  • 50 hours community service
  • Advanced DUI school
  • Auto Impound:  one or more vehicles for 10-30 days
  • Ignition Interlock Device:  1-2 years

Third DUI Offense

  • Fines:  $1,000-$5,000
  • Probation:  one year
  • Jail Time:  30 days to 5 years (if it is the third conviction within 10 years or if it is charged as a felony)
  • License Suspension/Revocation:  180 days to ten years driver’s license revocation
  • 50 hours community service
  • Advanced DUI school
  • Auto Impound:  All vehicles for at least 90 days
  • Ignition Interlock Device:  at least 2 years
  • State may decide to charge as a felony

Fourth DUI Offense

  • Fines:  $1,000-$5,000
  • Probation:  1-5 years
  • Jail Time:  up to 12 months or five years depending on how you are charged
  • License Suspension/Revocation:  permanent
  • 50 hours community service
  • Advanced DUI school
  • Auto Impound:  vehicle(s) may be subject to forfeiture
  • Ignition Interlock Device:  at least 2 years

DUI with Property Damage/Bodily Injury

  • All of the above penalties dependent upon number of previous convictions and dates of convictions
  • Realistic jail sentence for property damage
  • Realistic jail sentence for physical injury
  • Mandatory jail sentence of 7 years for serious bodily injury
